What if I don’t sign my comp’ agreement?

You are in a difficult situation because once a compromise agreement becomes a possiblity, it is likely that you won’t want to carry on working there. So if you’re not happy with your compromise agreement then you should try to negotiate a better settlement with your employer.

If you leave without signing a compromise agreement, then you will not receive any ex-gratia payment from your employer. You will only be entitled to receive any statutory redundancy pay and any contractual benefits. Your contractual entitlements are sacrosanct – an employer cannot take these away from you. These include notice pay, holiday pay and any salary outstanding. Of course you will be entitled to make an employment tribunal claim.

You might want to get a rough idea of the value of your case by filling in the Compromise Calculator. Also think about getting some representation have a look at the Employee Experiences to see how others in your situation were helped on their journey.

If you want to know your options if you don’t sign, or if you have any other compromise agreement query, including how to get representation at no up front cost, email us on info@compromiseagree.com, call us 0800 533 5134 or send a message in the box to the bottom right.
